## Frequently asked questions

### Do mobilized employees keep their salary?

No. Since July 19, 2022, the obligation to pay mobilized employees their average salary has been abolished (Law No. 2352-IX): no salary is accrued, as the employee does not actually perform their duties. At the same time, they keep their job and position (Article 119 of the Labor Code of Ukraine).

### Can a non-profit organization be a VAT payer?

Yes. Non-profit status does not automatically exempt an organization from VAT: for example, when it buys services from nonresidents, the place of supply is Ukraine, and such transactions are subject to VAT. NGOs should analyze specific transactions rather than rely on their status alone.

### Who is responsible if an accounting error is found?

Our responsibility is governed by the agreement. UHY Prostir has professional liability insurance with a limit of up to UAH 10 million. The availability and amount of insurance compensation depend on the circumstances and policy terms.

### Do employees have to give two weeks’ notice when resigning under martial law?

As a general rule, yes, but martial law added an exception: an employee may resign without the two-week notice period if there is a risk to their life or health. In other cases, the standard procedure applies, with the required paperwork and full payment of wages due on the last working day.
